Products Liability & Recalls

Products liability is a facet of the law in Florida which protects consumers from faulty, defective or unreasonably dangerous products. This area of the law allows consumers to seek monetary damages through a claim or lawsuit as a result of any injury or death caused by these products. Florida products liability laws permit injured parties to seek financial compensation from any company involved in manufacturing, marketing, or selling of the defective product.

The three main causes of products liability claims consist of an injury due to a defective warning, design defect, or a manufacturing defect. A defective warning means that the products did not clearly, if at all, warn the consumer of the potential hazards associated with it. A design defect is a problem with the product’s overall manufacture which causes the injury. A manufacturing defect is when the product may be designed well but is either put together poorly or made with faulty parts.

Most Florida products liability lawsuits fall into one of several types of categories including negligence, strict liability, breach of warranty, and other related consumer protection claims. While some of the more disastrous cases in Florida include dangerous or defective automobiles and medical equipment, products liability cases reflect all types of products and injuries.

In Florida the laws are particularly complicated and products liability cases should be handled by an experienced law firm. Under state law, for example, “strict” product liability can be claimed if a product is in unreasonably dangerous condition when being used properly. It is the priority of our offices in appropriate cases to prove that the dangerous product was in such a condition and that the condition caused the injury or injuries.

Florida also has a statute of limitations or time limit in which to file a lawsuit that varies depending on the case. All claims in the Ft. Lauderdale, West Palm Beach or Boca Raton areas and throughout Florida should be made as early as possible. It is important to our firm to only handle meritorious cases that will result in the lawful benefit to our clients and any future consumers who may become injured in the same manner.

Many times defective and dangerous products are recalled. These recalls are usually followed by national class action lawsuits throughout the United States. You may receive a recall notice or notice of pending class action for which you or a family member are a member of the class. Many members of the class have no idea what to do or how to respond to these notices. At Willis Law, P.A., we represent clients who are potential members of product liability class action lawsuits and we do it on a contingent fee basis. There are no fees or costs owed for our legal work unless we are successful in obtaining a recovery on your behalf from the class action or negligent manufacturer or distributor of the dangerous product.

If you or someone you love has been injured by a faulty, defective or dangerous product in the Ft. Lauderdale, West Palm Beach or Boca Raton area, or anywhere in Florida and you believe it was the fault of the product itself, you may have a potential products liability lawsuit.
