Florida PIP / No-Fault Insurance Claims
Any Florida resident who owns an automobile is legally required to be covered by insurance called PIP/No-Fault automobile insurance. This insurance provides coverage for people involved in auto accidents in Florida. The insurance covers 60% of any lost wages and 80% of medical expenses resulting from the accident up to $10,0000.00 (less any deductible). It can also cover other items of expense such as mileage to and from medical providers. The coverage is paid out regardless of whose fault the accident was. A set time limit is in effect in Florida known as a statute of limitations. The Florida PIP/No-Fault statute also has a myriad of deadlines for your medical providers to meet to get your claims paid. This is important to realize because if you have a claim and you or your medical providers fail to file it within the legally appointed time limit you can lose all potential benefits. Even if you meet the time deadlines, you and your medical providers must comply with a presuit demand procedure. If you don’t comply with the presuit procedure, the PIP/No-Fault insurance case can get thrown out of court even if the evidence is clear that you are owed the funds.
It is important to note that you should not sign or agree to any settlement regarding your PIP benefits, including any medical expenses and lost wages, before contacting Willis Law, P.A. Medical disputes, payment of lost wages and other areas can all be confusing and can leave innocent parties in the hands of unscrupulous companies.
