Florida Dog Bite

Florida’s dog bite laws were enacted to protect people from dog attacks and ensure that dog owners are held liable for the actions of their pets. As dog attacks become more frequent around the country, several states and cities are enacting new, stricter laws to try and stop what many consider to be an epidemic. In Florida, dog bite laws are very complex and are a mix of state, county, and city laws.

Dog owners in Florida are liable for any damages their pets cause to other people, animals, or even property. The owners are liable for damages when their dog attacks a person if that person was legally on the property, or if the attack occurs in a public location. The dog owner is liable for their dog’s attack even if their dog had no prior history of attacks or aggressive behavior.

Because there are so many variations of the dog bite laws in Florida, it is important to contact only an experienced lawyer that can handle your particular case. Damages recoverable may be reduced or completely barred if certain circumstances were in place. For instance, people over the age of six that have provoked a dog prior to the attack may have their damages reduced. Also, a dog owner who displays a sign on the property reading “Bad Dog” may have a complete defense to a dog bite claim. However, the sign must be clearly readable and in a prominent place near where the attack occurred.

Florida dog bite victims, including those in the Ft. Lauderdale, West Palm Beach and Boca Raton areas may recover damages through an attorney on several fronts. Dog bite statutes cover compensation relating specifically to the dog’s attack. Other laws known as common laws or judge made law may also be used in a lawsuit if it is provable that the dog owner was negligent and partially at fault in the attack.

Florida also has several laws knows as “Dangerous Dog” statutes. These statutes ensure that any dog that has had a previous history of violence or misbehavior must be monitored and cared for more carefully than nonviolent dogs. Some breeds of dogs, such as pit bulls, may also fall into this category even if they have not previously attacked anyone. If a dangerous dog is involved in an attack, the penalties can be much worse for the owner and more monetary damages can be sought.
