If a child has a head injury or other disabling injury, the settlement has to provide care for the rest of his or her life. It can be very substantial. In Florida, any settlement over $15,000 requires a guardian ad litem to independently review the case and recommend a settlement to the judge.
When the case is settled, the court appoints another guardian to handle the settlement and make sure it is accounted for and spent properly. That guardian files a report every year until the child turns 18. During the child's adult life, other accommodations must be made to account for the settlement.
